General terms and conditions (GTC) for the car rental agreement of Rent a Car Center 5700 Zell am See<\/p>\n
1. General<\/strong><\/p>\n The basis of this rental contract are exclusively the conditions listed overleaf and the following terms and conditions. At the conclusion of the lease as well as additional agreements, only written form regarding legal validity is agreed. R\u00fcckholkosten, der Verdienstentgang f\u00fcr die angemessene Dauer der Wiederbeschaffung eines gleichwertigen Ersatzfahrzeuges bzw. der Reparatur des Mietfahrzeuges je Ausfalls- bzw. Stehtag in pauschalierter H\u00f6he eines Tagessatzes zum Normaltarif lt. Preisliste den Vermieters f\u00fcr das betreffende Mietfahrzeug unabh\u00e4ngig vom Nachweis eines effektiven Verdienstentganges bzw. der konkreten Vermietbarkeit des abhanden gekommenen oder besch\u00e4digten Mietfahrzeuges durch den Vermieter, sowie alle mit der Schadensbearbeitung dem Vermieter entstehenden Kosten von Mieter u. von Lenker gem\u00e4\u00df Ziffer 6, an den Vermieter zu bezahlen sind. b – mit Haftungsreduzierung: Hat der Mieter und der Lenker eine Haftungsreduzierung erworben reduziert sich die Haftung bei Besch\u00e4digung d. Mietfahrzeuges ohne R\u00fccksicht auf die Schadensursache -durch Unfall oder sonstiger Besch\u00e4digung grunds\u00e4tzlich auf einen Betrag von netto \u20ac 590,– p. Schaden. Bei Besch\u00e4digung durch h\u00f6here Gewalt oder Diebstahls des Mietfahrzeuges betr\u00e4gt der Selbstbehalt des Mieters bzw. des Lenkers netto \u20ac 1000,–.Dar\u00fcber hinaus haften der Mieter und der Lenker dem Vermieter in voller Schadensh\u00f6he – unter Anrechnung des o. angef\u00fchrten Selbstbehaltes – bei Vorliegen von Vorsatz, grober Fahrl\u00e4ssigkeit, Falschbetankung, Fahrunt\u00fcchtigkeit (wie z.B. Alkohol- oder Drogeneinfluss, \u00dcberm\u00fcdung etc.), Unfallflucht, Nichtbeachtung der Gesamth\u00f6he des Mietfahrzeuges u. Sch\u00e4den im Innenraum.
